By accessing or using Dolfy ("the Service"), provided by AEGONTECH LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

Dolfy is a software-as-a-service (SaaS) platform that enables users to design mobile applications using AI-powered tools and export production-ready React Native components.

2. Description of Service

Dolfy provides an AI-powered platform for designing mobile applications. Our services include:

• AI-guided product design workflow
• Design token and component generation
• Live preview of mobile app designs
• Export of production-ready React Native components
• Project management and version control

3. User Accounts

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

4. Intellectual Property Rights

4.1 Your Content

You retain all rights to the designs, specifications, and content you create using Dolfy. You grant us a limited license to host, store, and display your content as necessary to provide the Service.

4.2 Generated Code

The React Native components and code generated by Dolfy based on your designs are owned by you. You may use, modify, and distribute this code without restriction.

4.3 Our Property

The Dolfy platform, including its AI models, algorithms, user interface, and documentation, remains the exclusive property of AEGONTECH LLC.

5. Acceptable Use

You agree not to use the Service to:

• Create content that is illegal, harmful, or violates third-party rights
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Reverse engineer or extract source code from our platform
• Use automated systems to access the Service without permission
• Resell or redistribute the Service without authorization

6. Credits and Payment

6.1 Pay-As-You-Go Model

Dolfy operates on a pay-as-you-go credit system. Credits are used to access AI-powered features including design generation, preview images, and messaging. You may purchase credits at any time through our platform.

6.2 Free Credits

New users receive a one-time welcome bonus of free credits upon registration. These credits are subject to the same terms as purchased credits and have no cash value.

6.3 Credit Purchases and No Refund Policy

All credit purchases are final and non-refundable. Due to the digital and consumable nature of credits, we do not offer refunds for purchased credits under any circumstances, including but not limited to:

• Unused credits remaining in your account
• Dissatisfaction with AI-generated outputs
• Account termination or cancellation
• Changes in pricing or credit packages

By purchasing credits, you acknowledge that you are acquiring a digital product that is consumed upon use and agree to waive any right to a refund.

6.4 Credit Validity

Purchased credits never expire and remain in your account until used. Credits have no cash value and cannot be transferred, sold, or exchanged for cash.

6.5 Service Issues

If you experience a technical error on our end that results in credits being deducted without receiving the corresponding service (e.g., a failed generation due to server error), please contact us. We will investigate and, at our discretion, may restore the affected credits to your account.

6.6 Payment Processing

• Payments are processed securely through third-party payment providers (Stripe)
• All prices are displayed in USD unless otherwise specified
• You are responsible for any applicable taxes on your purchases

6.7 Pricing Changes

We reserve the right to change our pricing, credit packages, and pricing model at any time without prior notice. This includes, but is not limited to:

• Adjusting credit prices or package sizes
• Introducing new pricing tiers or subscription models
• Modifying the credit cost for specific features
• Changing pricing due to third-party cost increases (e.g., AI model providers)

Any credits you have already purchased will remain valid regardless of pricing changes. New pricing will apply only to future purchases made after the change takes effect.

7. AI-Generated Content

Dolfy uses artificial intelligence to assist in design and code generation. You acknowledge that:

• AI-generated content should be reviewed before production use
• We do not guarantee AI outputs will be error-free or suitable for all purposes
• You are responsible for testing and validating generated code
• AI suggestions are tools to assist, not replace, professional judgment

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AEGONTECH LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

Our total liability for any claims arising from these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms. Upon termination:

• Your right to use the Service will immediately cease
• You may export your data within 30 days of termination notice
• We may delete your data after the export period

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.
